Erb’s Palsy Is Often Caused By Medical Malpractice

Any deformities or disabilities can be hard to bear, but it is particularly troubling when it is one of our children who suffers. When birth-related injuries such as Erb’s palsy could have been easily avoided with adequate medical care, it is extremely traumatic for parents and children alike.

At Goldsmith & Goldsmith, LLP, we can represent your interests and protect your right to receive full and fair compensation if your child has suffered Erb’s palsy or other birth injuries. With decades of experience representing clients in Bergen County, Hudson County and Essex County and throughout New Jersey, we have both legal and medical knowledge and training. We can help you establish liability in an Erb’s palsy claim to receive the full measure of compensation to which you are entitled.

What Is Erb’s Palsy?

Erb’s palsy and related conditions such as Klumpke’s palsy severely limit arm movement. They are caused by an injury to the nerves (brachial plexus) of the arm as a result of improper management of a child’s delivery.

In rare instances, Erb’s palsy is a result of unavoidable trauma to the child during birth. More often, the condition can be directly attributed to error or negligence on the part of the doctors, nurses or other medical professionals involved with the birthing process.

Common causes of Erb’s palsy during birth include:

  • Excessive pulling on the shoulders during delivery
  • Inappropriate use of forceps or vacuum technology
  • Failure to perform a cesarean (C-section) operation when a child is stuck in the birth canal
  • Failure to foresee a difficult birth due to head size, narrow birth canal or previous birth complications
  • Improper delivery or rotation of a breech baby (emerging feet first)

Attorney Lee S. Goldsmith combines a medical degree with his legal training, which uniquely positions our firm in this type of medical malpractice claim. We will look over all of the medical records and reports from before pregnancy through the birth. If there is any evidence of medical negligence or malpractice that led to your child’s Erb’s palsy, we will find it, and we will fight aggressively to help you obtain full and fair compensation.
